Proving Need vs. Ability to Pay

Good day, everybody. This is Dustin Peterson, and I am the Oklahoma City Attorney.
Today’s topic concern is alimony in Oklahoma, and how you get it. What if you can demonstrate that your spouse has the ability to pay it? That’s not going to be sufficient, I’m afraid. What you’re going to have to show is that you have a demonstrated need to receive it in what’s called the post-marital economic readjustment period, and there’s going to have to be a reasonable amount of time for you to receive that alimony before you can get back on your own feet.
Certainly, you’re going to need to take steps to find a job and start earning income on your own, but if you, during the marriage have been accustomed to a certain lifestyle, the judge will look at that and possibly award you alimony that will keep you at that status or close to it while you work toward being able to provide that level of security on your own.
Now, can you become a doctor and go to medical school during this time when you have no other college degrees? Probably not. That’s going to take too much time. However, if other circumstances are available, you could perhaps go back and get an MBA or something of that nature if that is determined to be on a reasonable track for you.
